Terms of Service
These Terms of Service ("Terms") govern your access to and use of NodPulse ("NodPulse", "we", "us"), including our websites, dashboard, agents, and the origin-cloaking and traffic-cleaning services described at nodpulse.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using the Service for an organization, you agree on its behalf and represent that you are authorized to do so.
The Service
NodPulse places itself in front of a website or service you control. Depending on your plan, we clean inbound traffic, replace server-identifying response headers, and route traffic through NodPulse gateways and relays so that your origin server can close its inbound ports and leave public DNS. Plan details, limits, and prices are described on our pricing page and may change as described below.
Accounts
You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your account. Notify us promptly at support@nodpulse.com if you suspect unauthorized use.
Your content and domains
You retain all rights to the websites, applications, data, and traffic you route through the Service ("Your Content"). You grant us only the limited rights needed to operate the Service for you, such as proxying and transporting your traffic and issuing certificates for domains you add. You represent that you own or are authorized to use each domain and origin you connect.
Acceptable use
You may not use the Service to host, transmit, or conceal material or activity that is illegal, that infringes others' rights, that distributes malware, that facilitates fraud or phishing, or that is intended to attack, overload, or gain unauthorized access to any system. You may not use the Service to evade lawful process or to hide infrastructure used for the foregoing. We may suspend or terminate accounts that violate this section, and we may cooperate with lawful requests from authorities.
Subscriptions, trials, and billing
Paid plans are billed monthly in advance through our payment processor, Stripe. The Shield plan begins with a 14-day trial that requires a valid card; if you do not cancel before the trial ends, your card is charged and the subscription continues month to month. You can cancel at any time from your dashboard or by emailing support@nodpulse.com; cancellation takes effect at the end of the current billing period and service continues until then. Service availability
We work to keep the Service reliable but do not guarantee uninterrupted or error-free operation except where a written service-level agreement applies to your plan. We may perform maintenance and may modify or discontinue features with reasonable notice.
Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. NodPulse reduces exposure of your origin and cleans traffic; it is one layer of defense and is not a guarantee against all attacks, discovery, or data loss. You remain responsible for securing your own systems and for your backups.
Limitation of liability
To the fullest extent permitted by law, NodPulse and North South Industries will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.
Termination
You may stop using the Service and cancel at any time. We may suspend or terminate your access for violation of these Terms, non-payment, or where required by law. On termination, your right to use the Service ends; we may delete account data after a reasonable period.
Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with a new effective date and, where appropriate, notified to you. Continued use after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of South Dakota, USA, without regard to conflict-of-law rules. Courts located in South Dakota will have jurisdiction over disputes, except where applicable law provides otherwise.
